The Hindu Marriage Act, 1955 applies to Hindus, Sikhs, Jains, and Buddhists. If you’ve already had a traditional wedding ceremony (with pheras, sacred fire, etc.), this is the route to get your marriage legally registered in Delhi.
The Hindu Marriage Act does not solemnize your marriage — it only registers an already-performed marriage. Your wedding ceremony (pheras) must have already taken place for this registration to be valid.
Step-by-Step Process
Visit the District Marriage Registrar
Both parties visit the District Marriage Registrar of the area where at least one has resided for 30+ days. Delhi has registrars in all 9 districts — North, South, East, West, Central, New Delhi, South-East, Shahdara, and North-West.
Submit Joint Application (Form No. 1)
Fill out Form No. 1 — available at the office or through Delhi’s e-District portal. Both husband and wife must sign jointly.
Document Verification
The registrar verifies all submitted documents. Originals must be carried. Any discrepancy can lead to rejection — this is exactly where my legal assistance saves you time and multiple visits.
30-Day Notice Period
A notice is displayed at the registrar’s office for 30 days. If no objection is raised, the process moves forward. In practice, with complete documents, this is a smooth formality.
Certificate Issuance
After successful verification, the Marriage Certificate is issued. In many Delhi districts, with proper documentation, the certificate comes through in 7-15 days.

Marriage Under Special Marriage Act, 1954
The Special Marriage Act, 1954 is India’s secular marriage law. It’s the go-to option for inter-religion marriages, inter-caste marriages where families might object, and couples who want a civil marriage without any religious rituals.
This Act both solemnizes AND registers the marriage in one process. No prior religious ceremony is needed. The marriage officer performs the ceremony at the registrar’s office itself.
Complete Process
File Written Notice (Section 5)
Both parties give written notice to the Marriage Officer of the district where at least one has resided for 30+ days, with names, ages, occupations, and parental details.
30-Day Mandatory Notice Period
Notice is displayed on the registrar’s notice board for 30 days. This is mandatory and CANNOT be waived. During this period, anyone can file objection on valid legal grounds.
Objection Handling (If Any)
If someone objects, the marriage officer conducts an inquiry within 30 days. Frivolous objections are dismissed. Having a lawyer during this stage is critical — I’ve defended many couples from Dwarka and across Delhi against false family objections.
Declaration & Solemnization
After the notice period, both parties and three witnesses appear before the marriage officer, sign a declaration form, and the officer solemnizes the marriage.
Certificate Issued Immediately
The marriage certificate is issued on the spot after solemnization — valid across India and internationally.

Court Marriage in Delhi — Complete Process
Court marriage in Delhi is essentially marriage under the Special Marriage Act, performed directly at the Marriage Officer’s office. No pandit, no mandap, no rituals — just the law.
“Court marriage” is not a separate law — it’s a method of solemnization under the Special Marriage Act, 1954. The process, 30-day notice period, and documentation are the same as SMA registration.
Who Should Opt for Court Marriage?
Arya Samaj Marriage in Delhi
Arya Samaj marriage is popular for couples who want a legitimate religious ceremony that’s simple, affordable, and completed in a few hours. After the Arya Samaj ceremony, the marriage is then registered under the Hindu Marriage Act.
Process
Book an Arya Samaj Mandir
Contact an Arya Samaj temple in Delhi — popular ones are in Karol Bagh, Patel Nagar, and Paharganj. Book a date and time.
Vedic Ceremony (2-3 Hours)
The ceremony includes Havan, Vedic mantras, and pheras around the sacred fire. Completed in 2-3 hours with minimal expenses.
Receive Arya Samaj Certificate
The temple provides a temporary marriage certificate. But this is NOT the government certificate.
Register Under Hindu Marriage Act
Using the Arya Samaj certificate as proof, apply for government registration at your district registrar’s office.
Many couples think the Arya Samaj certificate is enough. It is NOT a government-recognized marriage certificate. You must still register at the district registrar’s office. Without the government certificate, your marriage is not valid for passport, visa, or court purposes.
NRI & Foreign National Marriage Registration

Tatkal registration is available only under the Hindu Marriage Act. There is NO tatkal facility under the Special Marriage Act — the 30-day notice period is mandatory by law.
